Terms & Conditions

This policy sets out the standards Etched Electrical (“we”, “us”, “our”) holds itself to across safety, compliance, quality, environmental practice, privacy and client service, and the terms and conditions that apply to our quotes and invoices. It applies to all work we carry out and is available to clients on request.
1. Work Health & Safety
We carry out all work in line with the Work Health and Safety Act 2011 (NSW) and the Work Health and Safety Regulation 2017 (NSW). This includes safe isolation and testing procedures before work begins, use of appropriate PPE, and keeping work areas secured from public and client access while live or exposed wiring is present.
Any notifiable incident is reported to SafeWork NSW immediately, investigated, and recorded for at least 5 years in line with our statutory obligations.
2. Licensing & Compliance
All work is carried out by a licensed electrician and complies with AS/NZS 3000:2018 (Wiring Rules), the Home Building Act 1989 (NSW), the Electricity (Consumer Safety) Act 2004 (NSW), and the relevant network distributor’s Service and Installation Rules. A Certificate of Compliance for Electrical Work (CCEW) is issued and lodged for all applicable work.
3. Quality & Workmanship Warranty
Residential work is covered by the statutory warranties under section 18B of the Home Building Act 1989 (NSW): 6 years for major defects and 2 years for all other defects, running from the date work is completed. Any defect should be reported to us in writing as soon as it is identified, and we will act on it in line with our obligations under the Act.
4. Environmental & Waste Disposal
Redundant wiring, fittings, switchboards and e-waste are disposed of responsibly and in line with the Protection of the Environment Operations Act 1997 (NSW). Where older switchboards or fuse backing boards are suspected of containing asbestos, they are handled and disposed of through a licensed asbestos waste provider. Scrap metal and cabling are recycled where practicable.
5. Privacy & Data Handling
As a small business, Etched Electrical currently sits under the $3 million turnover exemption in the Privacy Act 1988 (Cth). We nonetheless handle client information — contact details, site access information and payment records — in line with the Australian Privacy Principles, and only use it for quoting, job delivery, invoicing and compliance record-keeping. We do not sell or share client information with third parties except where required by law. Note that the small business exemption is scheduled to be removed from 10 December 2026, after which we will comply with the Privacy Act in full.
6. Complaints & Dispute Resolution
If you’re unhappy with any aspect of our work, contact us directly in writing and we will respond within 2 business days. We aim to resolve all complaints fairly and promptly. If a matter cannot be resolved between us, either party may refer it to NSW Fair Trading’s dispute resolution service.
7. Quotation Terms & Conditions
7.1 Quotes Given Without a Site Visit
Where a price is given over the phone, by email, or by any other means without Etched Electrical first conducting an on-site inspection (“word of mouth” or verbal pricing), that figure is a preliminary estimate only, based solely on the information you have supplied. It is not a fixed-price quote and is not binding.
Once an on-site inspection has been carried out, the price may increase or decrease to reflect the actual scope of work, site access, existing wiring and switchboard condition, compliance requirements, or other conditions found on site. Any variation from the original verbal figure will be confirmed with you in writing before work proceeds. Only a written quote issued following a site visit is binding on Etched Electrical.
7.2 Quote Validity
Written quotes are valid for 7 days from the date of issue. After this period, prices may be revised to reflect changes in material costs, labour rates, or site conditions.
7.3 Deposits & Booking Confirmation
To confirm and secure a booking:
- Commercial and non-residential work — a deposit of 30% of the total quoted price is required.
- Residential building work, as defined under the Home Building Act 1989 (NSW) — a deposit of 10% of the total quoted price is required, being the maximum permitted under section 8 of that Act.
No booking is confirmed and no works will be scheduled until the applicable deposit has been received in cleared funds. The deposit is credited against the final invoice.
7.4 Variations
Any work outside the scope of the accepted quote is a variation. Variations will be priced separately and require your approval (written or verbal) before proceeding, except where additional work is reasonably necessary for safety or legal compliance, in which case you will be notified as soon as practicable.
7.5 Payment on Completion
Unless otherwise agreed in writing, the balance of the quoted price is due on completion of works and prior to Etched Electrical leaving site, or as stated on the invoice. Payment is by bank transfer only.
7.6 Cancellations
Cancellation after a deposit has been paid may result in forfeiture of some or all of the deposit to cover costs reasonably incurred by that point, such as materials ordered or time scheduled. Etched Electrical will act reasonably in assessing any such costs and will only retain what is fairly attributable to work already committed.
8. Invoicing Terms & Conditions
8.1 Payment Terms
Invoices are due on receipt, unless otherwise agreed with you in writing before work commenced. Payment is by bank transfer only, using the account details shown on the invoice.
8.2 Late Payment Interest
If an invoice is not paid by its due date, interest accrues on the outstanding amount at 10% per annum, calculated daily from the due date until the date payment is received in full, in addition to the amount owing. This is without prejudice to any other right or remedy available to us.
8.3 Retention of Title
Ownership of any materials, fittings, and equipment supplied remains with Etched Electrical until the invoice covering those items is paid in full, even though they may have been installed. Risk in those items passes to you on delivery or installation. Until payment is received in full, Etched Electrical may, to the extent permitted by law, enter your premises to identify and recover unpaid materials or equipment.
8.4 Building and Construction Industry Security of Payment Act 1999 (NSW)
Nothing in these terms limits or excludes any right you or we may have under the Building and Construction Industry Security of Payment Act 1999 (NSW), including the right to make or respond to a payment claim.
9. Consumer Guarantees
Nothing in this policy excludes, restricts, or modifies any guarantee, right, or remedy available to you under the Australian Consumer Law that cannot lawfully be excluded.
10. Governing Law
This policy, including the Quotation Terms & Conditions and Invoicing Terms & Conditions above, is governed by the laws of New South Wales, Australia, and the parties submit to the jurisdiction of its courts.
